Capital management is trying to make me pay them by check by phone for a settlement that I agree for. could they turn around after paying them the settlement amount and ask for the remainnig balance even if they faxed me a letter saying that they are willing to settle on behalf of the creditord. what are my guarantees???

Well if they sent you a letter, you can hold them to that. Just
Well if they sent you a letter, you can hold them to that. Just goto your bank and get a cashier's check, or go and buy a money order and make sure you photocopy either and mail it, certified mail return receipt. KEEP that settlement letter! It is your only proof.
Did they properly validate the debt?
Whatever you do, do NOT pay them directly out of your bank, that gives them your banking info and they can later try to dip into it and that would just be a huge headache. If they do try to come at you for the remainder, simply tell them you satisfied the settlement at the amount they agreed too. If needed, send them a cease & desist letter if they keep bugging you.
