Going To Court Tomorrow (thursday) - What Do I Need?

Capitol One finally followed through on their threats to sue me;I received a summons and must appear in court tomorrow. There's no way I can give them any money - we're behind on house payments, vehicle payments, you name it, we're behind on it.
So, I guess my question is: What do I need to take with me? Do I have to prove to them that I don't have any money or do I just let them think I'm a liar (they've called me that on the phone before)?
I've never been to court before, so I really don't know how this works. It's really aggravating me, because my husband is out of town working and my family is scrambling trying to see if one of them can take off work to watch my 2 year old daughter because I can't pay someone to keep her! :x I've been tempted to take her with me and just tell them - if they say something - I can't afford a babysitter, but that's probably not a good thing to do.

Also, will I need to close my bank accounts afterward? We're moving out of state in a couple of weeks and will needto close them anyway, but I'd rather wait until closer to time to move if I can.


I've got court tomorrow too.

I'm making a motion for discovery asking for more documentation.That's the only way that you can get a debt validation after it's been taken to court.

I don't have any advice for you. This is my first time to go to court too.

what part of MO are you in? If you're in Cape County, I might see you there! :-)

I already did the DV a couple of months ago, so that won't work. I'd like to bring up the fact that they've called my parents and grandparents, but since I don't have specific times and the name of the people that called, I doubt I can.

I was supposed to be in court at 9:30 this morning, but my daughter and I woke up in the middle of the night with the flu. Called the Judge's office. I told them what was going on, and that I would still come if they wanted me to (and pray that I did not throw up on anyone). They told me not to come, just contact the attorney later.

Is it going to make any difference if I do contact them? Do I just tell them that I don't have any money? That's all I had to tell them if I went to court!
