Had a Capitol One Card years ago. It got charged off and I haven't heard from them for years. They clam it has been since 2005. I think it was 2002 or 2003. I was paying a collection agency back in 2002-2003. BUT ALL CORRESPONDENCE STOPPED AND I RECIEVED NO STATEMENTS ALL THIS TIME UNTIL NOW. THEY ACCUMULATED INTEREST AND LATE CHARGES TOTALING OVER 8000.00. THE LETTER SAID AT THE TIME OF CHARGE OFF THE BALANCE WAS 2800.00 WHAT CAN I DO ABOUT THIS?


You haven't mentioned the state you live in. If, as per your state laws, your debt account is passed SOL, then your creditor won't be able to file a lawsuit against you. Even if your creditor charges off the account and sells it off to a collection agency after the debt is passed SOL, the collection agency can contact you for payments but won't be able to sue you for the debts. However, if you pay a certain amount of money after the SOL is passed, then the SOL will restart and your creditors/CA will be able to sue you for the debt.

If your debt is not passed SOL, then you can negotiate with your creditor and set up a payment plan to pay off the debt and get rid of it.
