Car Rental Collection

I rented a car in April of 2006 and returned the car three days later. When I turned the car in they gave me the ok and charged my credit card for the amount that was due. I then recieved a phone call and letter stating that I owed $374 more for damage done to the car. I do not believe that I caused the damage and told them I was not going to pay the debt as they had thier chance to show me the damage that was done and failed to do so. I was just reached out to last month by a collection agency to pay that same amount. I dont want the bad credit to go on my record but I dont want to pay it because I did nto do the damage. What are my recourses

I believe in this case, you probably should have done more to make them prove that you had caused the damage to the rental car at the time that they accused you of it, rather than waiting until they sent it to a collection agency.

However, is it possible to go back to the rental agency, and ask them for proof that you caused the damage? In the meantime, if you feel you did not cause the damage to the car, and you do not owe this debt, you should contest the debt with the collection agency in writing.

Disputing the claim is not enough. The reason why is because all the collection agency needs to do is send in enough proof that will satisfy the CBR agencies.

If you did cause damage to the car it is likelty that the rental company will have picture proof. I would start there. Collect your evidence that this is not something you have done. They have to have written record.
