I am planning on moving to Canada at the end of the year and having my car voluntarily repossessed. I owe almost $7,000 on it and I'm not attempting to sell it because it has body damage from some not-at-fault accidents (broken taillight, dented hood, etc.). I'm pretty sure I am upside down on the loan, so I'm pretty sure I will owe money on the car after it's repossessed. My question is, how would the bank come after me if I'm in another country? Can they still sue me? Garnish my Canadian wages? If they enter a judgment against me in court, what happens if I don't show up for the court hearing? Can I talk to the bank before I leave the States and offer to work out a payment plan?

Thanks for your help.

Technically, they could follow you to Canada and sue you there. Realistically, they aren't going to follow you out of the country for a balance that small.

So your Canadian wages are probably safe. If they try to sue you here and you don't show up, they will get a default judgment. But a judgment here is not good in Canada.

You can talk to the bank; if you tell them you're on your way to Canada, they might rather settle something or take payment arrangements than get nothing at all...
