Courts usually set a time-frame for service-- for example in Illinois a creditor must serve the defendant within 1 year of filing or else the case will be dismissed for want of prosecution.
They can refile later on -- it has not been dismissed with prejudice. Albeit they will have to serve you if they want the case to go anywhere.
