Okay, so I think the Beneficial saga has finally ended for us. It's been a long struggle with them over the last few months. We had made payment arrangements with the attorney's office but for some reason they wanted a judgement against hubby. They really never answered that question and we never understood why. We just kind of feel like they were being buttheads.

Hubby went to court this morning and no one from the attorney's office showed up. It really didn't surprise us since they are four hours from us. They didn't even have a local represent them which kind of miffed the judge. Hubby took a personal day from work for this and he was home less than a half an hour later.

He said the judge was really nice to him. Hubby explained everything to him, about being on debt consolidation, then making all payments to them on time. He told them we refused to sign a consense judgement because he didn't want that on his credit report. He also stated that we had written payment instructions with the law firm. It basically states that if we miss a payment then they can sue. It's something along those line.

He showed the judge all of the paperwork that we had. He kind of shook his head from what hubby said. The judge couldn't understand what they were trying to do so he dismissed the case. Or it was ruled in our favor and he is sending a letter to the lawyer's office and to us stating this. We're not sure if they will try to appeal but we are hoping this is now behind us. :)

I'm glad this worked out for you. I currently have a summary judgment against me by Beneficial's thug attorneys on a second mortgage I defaulted on last year, when I became unemployed and my home was foreclosed on by the primary mortgager. I wish I had never gotten mixed up with these people.
