Stip of Discontinuance
Date: Fri, 05/28/2010 - 21:29
I owe $17,000 on a credit card. I made an agreement to pay it back, I made a lump sum payment and then I made 2 or 3 payments to them.. I was unable to continue so I stopped paying them. Months later I received a summons in the mail, wrong dates. I ignored it. Now I received a letter from them saying Enclosed for your records, please find a fully executed Stip of Discontinuance. The original stip has been sent ot the court for filing. Another paper says: Stipulation discontinuing action without prejudice.
I don't know what to do??? Should I contact the lawyer?? I'm scared to call them??? WHAT DO I DO?????
Why would a law firm stop the action of collections??? I don't understand????
I don't understand what you mean that you received a summons in
I don't understand what you mean that you received a summons in the mail, wrong dates? Can you elaborate on what you mean about wrong dates?
I would never ignore any type of summons. Even if there was something wrong with the dates, call the courthouse and talk to the clerk about it. It sounds like maybe if they did make a mistake that they are discontinuing the suit - without prejudice which means they can regroup and then pursue the case again. This may be their way of correcting some mistake they made to start the suit anew.
To be on the safe side, call the courthouse and give them the information on the papers. They will have their copy by now and can let you know what it means.
