NCO Violated Cease and Desist

Wish me luck everyone. NCO has an Amex account of mine for about $450.00. I don't dispute I owe it, but I am having financial difficulties. I've tried to talk to NCO to no avail. I sent them a Cease and Desist letter that was received and signed for on Aug. 28th. Today (Aug. 30) they called me at my office. I explained the Cease and Desist. The lady said, "I don't see it in the computer, therefore I don't have to abide". The law clearly states once it's been received by the company, communication must stop except for a couple of extenuating circumstance. So, I'm going to go after them for the $1,000.00 fine. That's twice what I owe. Let's see what they do.


Great, just do it!! Go ahead when the fdcpa law is broken by a debt collector. You must file the law suit and get compensated up to the extent of damages done. Keep the receipt of the letter signed by the CA's office in safe place. Also, keep a log of the calls done to you with the dates and time and the name of the caller. This will make your legal approach stronger. All the best.

just because it isn't documented in their computer system, doesn't mean they do not have to abide by the law. Sue them for the $1000 (and your expenses too!) and then use their money to pay the debt. Take whats left and donate it to charity, and get the write off on your taxes at the end of the year. One way or another there are ways of making these bottom feeders do something that actually benefits society.

This thought sounds noble, especially donating to the charity. I smiled after reading this. :)

Jay, Nail them to the wall. This company needs to be taught they cant treat people this way. I think they are on the top ten worst collection agencies list. Maybe you could call Budd Hibbs. He takes care of alot of complaints like that. Good Luck KYSIDE38. P>S> Go to buddhibbs.com
