I'm about to send a cease & desist letter to a couple collection agencies who are chasing my mom for his debt. A few questions, maybe you all can advise:

1. Should I mention in the letter from my mom that her husband has died?

2. I feel like I should remove the paragraph that says:

I/We have decided that we do not desire to work with a collection agency under any circumstances. I/We will contact the original creditor to resolve this matter directly, as circumstances warrant.

Not sure I will work with the original creditor either, as I don't even know if I'm responsible.

thoughts?

There are a couple things to consider..like if the debt was incurred during the marriage and if your mom lives in a community property state... I am not wholly up on this part of debt collection but I think that if your mom did not sign anything she can't be held liable. Someone with more knowledge should come around soon and hopefully answer that one better.

Since you want to stop all contact, then you should remove that part you mentioned as it does not pertain to the situation as you don't plan on dealing with anyone.

At the very most your mom could demand validation from these collectors.
