I sent two letters to the pdl place, and sent a copy to the PA State Attorney General's office. I also filed a complaint on the original person who called me and the AG's office sent me a follow up letter telling me that they are going to look into the matter.

A family filed back in October and she wants to help me financially, but she wasn't sure how long after bankruptcy she could apply for a loan. Sadly again, she thinks it for credit cards only. 5. Identify the original creditor
6. Prove the Statute of Limitations has not expired on this account
7. Show me that you are licensed to collect in my state
8. Provide me with your license numbers and Registered Agent
At this time I will also inform you that if your offices have reported invalidated information to any of the 3 major credit Bureaus (Equifax, Experion or TransUnion) this action might constitute fraud under both federal and State Laws. Due to this fact, if any negative mark is found on any of my credit reports by your company or the company that you represent, I will not hesitate in bringing legal action against you for the following:
1. Violation of the Fair Credit Reporting Act-reporting inaccurate information
2. Violation of the Fair Debt Collection Practices Act-continuing collection activity on a debt which has not been validated
Also during this validation period, if any action is taken which could be considered detrimental to any of my credit reports, I will consult with my legal counsel for suit. This includes listing of any information to credit reporting repository that could be inaccurate or invalidated or verifying an account as accurate when in fact there is no provided proof that it is.
REQUEST FOR CEASE AND DESIST OF CONTACT BY YOUR OFFICE: I would also like to request, in writing, no further contact, either in writing or telephone be made by your office to my home or to my place of employment, unless it is to provide validation or release of liability of the debt.

Hi Vollyball Mom....He did not identify the company name all he said was "This is Joe and you committed fraud. Payday Loan Yes. We gave you money on 2/22/08 and you have not paid us one dime. You committed fraud man. If we do not hear back from you, we will garnish your wages. I am not trying to be mean, but this is my job" and left an 800 number, which I think I left at work. The embarrasing part is he told our receptionist why he was calling. She put him through to my voice mail and sent me an email saying "payday loan message in your voicemail". I was so embarrased. I told her what happened and to not tell anyhone.

did you send the letters that volley gave?if not do it asap.if so start keeping track of activities like that one.you see PAYDAYLOANYES got the wood put to them in illinois to the tune of 250,000.00 for illegal collection tactics like that.get your ducks in a row,send your letters,take action.

The AG's office sent me a letter telilng me that they are going to look into the situation. Payday Loan Yes has a website that you can email to their "complaint" email. When I did, they never got back to me. Gee, I wonder why?

Dear Bayley,
From your post it is clear that the said collection agency has harassed you multiple times by calling your office and at the same time disclosing facts to a 3rd party. Thus, the collection agency has already breached fdcpa rules and guidelines.
In such a case, you can do the following: -
1. You can ask the concerned collection company to stop harassment.
2. If harassment continues then you can ask name along with the address of the collection agency. Then after report and complain it to the Federal Trade Commision(FTC), Better Business Bureau(BBB) or attorney general????????s office of your state (in writing).
3. Then after make a complain to the Consumer Protection Agency of the state you live in and send a copy of the same to the creditor (Payday Loan Yes) who had hired the concerned collection agency.
4. If the harassment still continues, then you have all rights to sue both the concerned agency and the creditor which employed it.
i. You can sue them up to a maximum amount of $1000 in case of small claims, or
ii. In case of outrageous violation of FDCPA rules, you can also take them to regular civil court
