I diputed a charge that they said I owed and when I got the results back from TransUnion there was a section on the information the creditor provided to identify the debt was mine, only it was a different last name and an address in Texas, so I looked up the address on the appropriate county assessors web site and then instead of it being angela diamond (wrong name) it showed up as being owned by me. Could this be a clerical error or identity theft? Either way, anyone know how to proceed?


Hi Angela--

The first thing I would do is send a validation letter directly to the creditor listed on your report. If you wouldnt mind posting the name of that creditor in here, we can provide a lot of information about how they usually do things so you will know what to expect. Hopefully it is a third party creditor and not a first party one. Is the debt being handled by a collection agency? did you find out by seeing it on your report, or has someone been calling you about the debt?

--you will find sample letters that you can use. Me personally, I use a different letter, but this is a good starting place. If they do not validate this debt as yours, you can then go back to Trans Union and again request that the entry be deleted from your report. In this request, you need to state that you requested proper validation, and the creditor will not provide it. Of course, this is only if they cannot provide it, and if this is a genuine mistake(or ID theft) then they wont be able to. if you have any questions on this, feel free to ask. The creditor's name is COMMERCIAL SERVICES GROUP. The original creditor is listed as Ballsy Paris Las Vegas Inc. It is stated that the debt is $1085.00 and that the account was opened on 3-01-01 and reported on 4-01-01. This is what my credit report said on 6-19-07, however, on the investigation results from Transunion dated 10-04-2006 it states that the it is a collection account, account type: open, date closed: 03-01, date verified 04-01. How can they verify a debt 5 years before verification was asked for? Also, it goes on to say that COMMERCIAL SERVICES GROUP did an inquiry on 08-08-06, the inquiry type was individual and the identifying information the provided was Angela M Diamond, 104 Milligan St, Sulphur Springs, TX. The rest of the story is that Transunion verified 5 accounts, three of the accounts show that the date verified is 9-06 which corresponds with when I filed the dipute and falls within the 30 days, the other two are the account from COM SERV GROUP, and the account from LVNV funding that I mentioned in an earlier post, it shows a verification date of 06-02, again, how can they verify a debt years before verification was asked for?

From what I am finding, this CA is not one of the worst. Bud Hibbs does not have them on his list, and he seems to have the most comprehensive information around. The only thing I waws really able to find is that their headquarters is in Louisville, KY:

Anyways, the validation thing is not what youre thinking. Credit bureaus do not have any involvement in the validation process. Their process is "verification", which is nothing more than the creditor verifying that the name and address they have for you is the same as what is listed on your credit file. Thats how it shows up as "verified" before you requested validation.
