Other members have posted the same issue with geneva. Everyonce in awhile someone posts that their account was hit...then several others will post the same thing...then it gets quiet again.. please dispute this with your bank if you have not done so already.

I know it sucks waiting for the other shoe to drop. I paid them 990.00 on a 300.00 dollar loan I'm hoping they will be satisfied with that and go away.

Oh, perry! I am soooo sorry! Geneva is becoming kind of famous for this now. Like goudah always says, it's rare for a pdl to find your new bank account information. Mine was found (not by Geneva) and I disputed it with my new bank. They took care of everything. However, dispute it and get it reversed. But my thing now is that Geneva knows your new bank account information (again). Crap. :shock:

There may be something you can.....since this is a new bank account that company just commited theft in my eyes, they had no permission from you to take money out of that account....so they did it illegally..ask your bank about what federal entity you should be complaining to.

Geneva Roth is the oc. Perry, since you have had your new account have you applied for any other PDLS . This is an easy way for a pdl to get your new info. For some reason, Geneva is famous for doing this. You do need to change accounts again.

I was going to ask along the same lines--when you entered into the agreement, did you sign anything that gave them permission to take money from any account of yours, or was it just related to the account you used for the payday loan? This is very important--because you have a major case against them if they only received permission to attack the one bank account, and not any others. You need to check on this ASAP.
As for legal action, my first thing would be to check on that information. The second thing I would do is contact your state's attorney general's office and file a formal complaint. This is simply theft--there is no way around that. The law requires a creditor to first take you to court and win a judgment against you on any outstanding debt before they can levy your accounts like this. They are not allowed to just take and take and take like that.
I would go back and get documentation of each and every time they have done this to you. I would get documentation for every penny they have taken from you in this manner, from every bank account except for the original account that was used for the transaction. Once you gather all that information, I would then file a formal complaint with the AG's office in your state as well as the one in their state.
I liken this to any creditor and any debt--they cannot just take whatever they feel like without going through the courts.

I think this is how they get around the legalities of this. All of mine had this clause in it. I have been lucky, no one has found my new accounts.

if thats the case, to be honest, I would challenge the legality of that clause. This is an industry that is filled with illegal activities, especially when it comes to the amount of interest charged. Since so many of these lenders break the law in terms of how much they expect you to pay back on a loan, I would fight it and claim that such a clause leaves the door wide open for this lender to take far more than the legally allowed interest and fees. Any clause that directly allows a party to take illegal action is not a legally enforceable clause, and I would fight it as such.
Of course, thats me, I dont like to let these people have anything when it comes to the law. They screw up a millimeter and I want it fixed.....
