Hi! I got a call last night from this company, they wanted my bank info to set up payment arrangements. I wanted a letter in writing about the debt but they said that on Friday a summons will be issued. What do I do next?


Well they have already violated a couple times. They threatened to sue even though you have a 30 day dispute window and they refused to send you a letter. By law they HAVE to send you a letter within 5 days of that first contact.

You should send them a DV and a partial cease & desist (tell them they can only write you, all phone calls must cease.) Inform them that they have already violated and that you wil not hesitate to fight for your consumer rights and will take them to court if you must.

Find out if your state allows you to record calls without them knowing, if not, then add this line to your DV letter:

ALL CALLS MADE TO ME OR BY ME WILL BE RECORDED.
