CI New York threatening phone calls

Lost my job here in CA several months ago resulting in our inability to pay our credit cards. We have sizable outstanding debt with two cards from BOA which I have not been able to pay for the last three months.
I've started receiving phone calls from a company called Creditors Interchange out of New York. Although I have not called them back, their messages threaten legal action if I don't contact them. from what I've read both here and on-line, their tactics are harsh and border on illegal.
At this point, I don't what to do. I'm trying to find employment which hopefully will allow us to resume some sort of payment structure to BOA but in the meantime I'm just trying to keep the lights on and feed my kids.
We've already liquidated or 401k (completely) to make payments to our creditors as well as our sons 529 college fund. we're down to one car a 1996 dodge which is falling apart and or home has devalued to the point of having 0 equity.
Again, I just don't know what to do. We've always had solid credit 740+ and have been responsible but the last year or so has been brutal. Any advice would be appreciated.


Have you received anything in th mail from them? If not the next time they call, answer it and verify if you are the person they are looking for-only your name, address and maybe the last 4 of your ss, nothing else, and inform them they now have 5 days as required by federal law to send you your Dunning letter, then hang up. When you receive that send them a Debt Validation letter, search this site for a template and format it to your situation, send it CMRRR, that way you get the green card back when they sign for, must send it CMRRR. If you wish you can search this site and see if you can get an address and go ahead and send a DV letter now, include in the letter, to have ALL correspondence by USPS ONLY. That will stop the phones from ringing. Make sure whoever calls you about any debt you send a DV letter and they legally own that debt and have the right to collect it. Search this site for all info regarding FDCPA and validation. DO NOT believe any collector who says that they dont have to send you anything, its required by law.

I have just received dunning notices about these and several other credit cards that are now past due. I will take your advice and send them the letter(s) you recommend. My question at this point is since I don't the means to settle this debt and make payments now, should I file bankruptcy? I really don't want to but know how I can get the creditors to hold off until I'm re-employed.
