What can I do if they continue to break the FDCPA? They have been telling me for 3 months they are processing paperwork to sue me. The speak nasty to anyone who answers the phone at my home. They continue to leave threatening messages on the voicemail (no FOTI message).
Have you send them the DV letter? If not, then send it immediate
Have you send them the DV letter? If not, then send it immediately through certified mail with a request of return receipt. I think you'll not get a call from them anymore.
Regarding the harassing phone calls, you can file a complaint against them with your local police as well as file a case against them with the FTC. As per FDCPA, debt collectors can be fined up to $1000 for each violation.
