Lawsuit with Citibank

My account with Citibank has been delinquent since November 2008. They did offer to settle for 56% off the total balance ($3200) to be paid in full. I didn't have access to that kind of cash, and was working on a settlement with another company at the time. I am enrolled in a debt settlement program and have successfully settled 2 accounts (out of 6) in a year period. I discovered that I was being sued by Citibank when I had 2 visits over a 2 week period from someone that I assumed now was a process server at my home. I was not home both times, so I have not been served the summons yet, but I checked out the Clerks of Court website, and sure enough it was there in the small claims court section. The account has been handled by Zakheim and Assoc., and my debt settlement company will try to work out a settlement with them. What do I do in the meantime? Has anyone been in a similar situation? I live in FL.


IMO you would need to file a reply to the summon since they have already sued you. Next, you should try to contact the collection agency and let them know your position. Inform them about your ongoing settlement process. You must try not to let them get a default judgment against you.

Failing that, you can also negotiate a settlement in court in order to avoid a judgement. See:

(It's for New York and so some slight details may vary with Florida.)

Hopefully your settlement company is able to hammer out a deal you can afford, that would be the best solution.

Thank you Chrys, and SC for your advise. Do you know if it's possible for me to contact the Clerks of Court office to make arrangement to receive the summon in their office? I'm trying to avoid default judgment, however I'm literally working 7 days a week, getting home at 10 each evening, so I keep missing this process server. I know they think I'm avoiding them, and I wish I could find a way to know when they're coming.
