Help - civil judgement!

Lets make this short...

I was not properly served and only found out when my bank send me a collection letter for a negative balance of $100 something or whatever.

What happen was Capital One filed a claim against me and won and they put a levy on my bank account which I had no funds in there, maybe 200 bucks.

I do not know how much they try to take out but this happened around Dec of last year when I found out.

From my credit report I see that Capital One won a civil judgment against me in the amount of $7xx.

My bank accounts are closed because I am afraid of the levy. I suspect my wages will be garnished if they found out I'm working again.

What should I do now ? I am from New York City.

How much do I really have to pay now ? 700 or a settlement or is it 700 + all other costs + interest ?

They put a Levy on the bank account and thats how I found out I was served. Well their was nothing much for them to collect in there, now I am on the books and I opened a new account with direct deposit. I am trying to fix this ASAP.

Any legal help would be greatly appreciated.

If you're married, you might want to open an account in only your spouses name (unless Capitol one is in both of your names) for direct deposit. If you didn't relocate at the of the default judgment, and still lived at the same address where you were receiving bills from Capitol One, you may be able to file a motion to vacate the judgment on that grounds of improper service. Are you certain it was Capitol One and not a collection agency on Capitol One's behalf?

It could be a collection agency or maybe an lawfirm but I remember seeing capital one, I will pay for a new report and post result here. I just obtained a free report from annualcreditreport and its not showing the public negative records so I am going to pay for one now.
