Hello everyone, I'm new to this forum and I hope someone can help me. I am being sued by Capital One Bank. I looked at my credit report and it is shown as a charge off and that the last payment was 03/2004 (which is NOT true). I was unable to make payments starting April 2003, however, I think I may have made one payment in October 2004 and it might have been to a collection agency. Does this reset my SOL? I am already past the 30 days response time for the summons which I know is bad, but I need to be armed with the correct information so I can protect myself. Sorry if this is confusing, I'm so lost. Thank you for reading.


hi,

first, the SOL could not be a defense in your case, because not enough time has gone by to hit the SOL expiration. Your last payment was in October 2004, and from then to now is not even three years. SOL is different in every state, but I dont think that any state has less than 3 years SOL on open accounts.

next, since you did not answer the summons, you will end up with a default judgment against you.

Everyone here is right, if u didn't answer the summons they recieved a default judgement! Also, as far as an attorney goes, there is really no need for one. Call the agency and try to see what u can work out as far as repayment!
