I recieved a letter from collectcorp that said my husband's boa credit card for $8000 has been placed them, a collection agency.They have been calling him at work so I called them back and told them I had mailed them DV letter and asked them to stop calling. She asked me to fax the letter because it was faster.I plan to but if I fax it do i still need to mail a dv letter too?
My husbands check is already garnished but I am scared.Does anyone know the background on this company or their track record of sueing? We just don't have the ability to pay them.


Cease and desisting a CA without cause is just stupid. In a lot of cases, the creditor has elected to assign you to a CA....3rd party placement. They choose to not to work with you. Being difficult and ceasing a CA WITHOUT CAUSE is basically telling the creditor that you refuse to pay and that you are electing to be difficult which could result in you being assigned to a collection law firm and being sued.

When you are assigned to a CA, of course they dont have YOUR best interest in mind....you are not a customer...the creditor is. They are working for the creditor, not you.

Make your requests in writing and be civil on the phone. Should the CA break the law, that is the time to C&D.....but not before.
