Call from a collection agency after almost 5 years

I just received a call from a collection agency attemptimg to collect a debt from Columbia House (CH)DVD. According to the collection agency, I received 2 dvd's in November 2004 and did not pay for them. This is the first I have heard of this. CH never sent me a late notice or anything. The person I spoke to said that CH doesn't send late notices, that you get the invoice with your dvd's and that is your only bill. Number one, I do not have the dvd's they claim they sent. I must have sent them back to them, but I have no proof that I did. I did have a membership with CH for a few years and during that time I sent numerous dvd's back. Never did I have any kind of receipt that it was sent back. They person I spoke to tonight said that I had to send them back so that CH had to sign for the return shipment, although nowhere in CH's return instructions does it say to do that and I haven't had a problem with other shipment I sent back (at least not that I have heard of yet). I have not been a member of the dvd club for at least 4 years. What do I do? Shouldn't have CH notified me at some point before this was sent to collection? I never got anything..phone call or bill.


You need to find out what the statute of limitations is on this type of debt in the state that you live in. You should also recieve a dunning letter mailed within five days of the date of initial contact. When you receive this, send a debt validation letter to them. Make them prove the debt to you. You can find a sample template on this site. I know when I was with Columbia House several years ago, if I did not make a payment on time, they did send reminders out.

Pennsylvania goes by the UCC for sale of goods, so the statute should be 4 years. You can do one of two things--you can send this debt collector a certified DV request letter, or you can send them a certified letter telling them not to contact you anymore because the debt has passed the applicable statute of limitations.
