Did I confess to this debt?

I called a CA before I knew about this website because my mother received a call at the house from the collection agency.

During the call, I stated that I was paying a law firm money every month on this account.

It turns out the CA is calling about another account besides the one I am currently paying.

Anyway here is the question. I never directly admitted or confessed that I owed on this account.

The collector asked me if I ever had an account with _____ credit card. I finally said" Maybe I don't know. I need to see the letter you mailed me first".
Several times I basically repeated that I needed to read the letter they sent me, NEVER directly admitting to the debt.

When the collector asked me "what other debts do you have?" I just said "I don't know?"

By saying the word 'maybe' or getting them confused with another creditor I am paying, did I open myself to verbally confessing to the debt that could be used in court even though the SOL has passed?

That was my only verbal communication with them. I have an attorney.


I beleive that you are ok with those statements.If anything were to go to court,it would simply show a person who is confused about the debt and would like more concrete info on it. Go ahead and send your validation letter to them and since you are tripping over yourself,it would be best to do everything in writing with the collection agency.

You have nothing to worry because it is your right to ask for the information of the debt on which the CA is assigned for collections. Even if they get your statement recorded, it will come out that you are exercising your consumer rights mentioned in the fdcpa. Like Cajun said above, send the DV letter and cover your basis..

Read this topic started by a member on proper debt validation. The CA must follow the rules.
