Desperate in Ohio regarding Smith Haynes & Watson

The collection agency rep called my office today at noon (he knows that I answer the phones at my work) asking the mailing address to the business. He then told me who he was (I automatically recognized his voice, since I've spoken to him way too much at work), and then said that he needed my work address so that he could send a court summons regarding the PDL. OK, FREAK OUT TIME!!!!! I told him that I was going to call him back with some debit card info (using the money I have set aside for gas until next payday) to process a payment since I don't want to go to court. Then I went on the chatroom on this website and was calmed a bit.

I'm currently paying off 3 internet Payday Loans (pdl's), and I'm desperate about the one (Cash Link USA) that is now being collected by Smith Haynes & Watson (SHW). The loan was given in 10/2006 for $400, and I received (finally) a Debt Verification (DV) today. It states that I owe $625, the original loan amount was $400, and "extension/NSF charges" of $531.25. The rep stated that I have only paid $175 to date, but the numbers don't jive with that. What the DV letter states is that the total accrued from the PDL is $931.25, and that I currently owe $625.00. He verbally told me I have only paid off $175, but the numbers he provided me make it that I have paid off $306.25!

He just called me back (it's now 4pm) for the debit card info and I told him that I cannot afford to make a payment today after all. He said "thank you" and hung up. Does this mean that I'm going to get served, at work, and will have to go to court?! HELP ME, WHAT DO I DO NOW?

Glad to see u posted! First of all, it is VERY unlikely that they would sue u over such a small amount! And also, they're trying to scare u into paying them, pdl's are famous for this! Take a few deep breaths and someone will be around shortly to help u out here with more knowledge on pdl's!
If u've been paying them since November of last year i'm willing to bet u've paid them back in full!
Be strong and get ready for a good fight! You have rights here and u will learn lots on this site about ur rights!

They are going to try and send a wage assignment to your payroll dept...you need to send a letter revoking any voluntary wage assignment to the company and notify your payroll VOLUNTARY WAGE ASSINGMENTS are illegal in OH...if you are uncomfortable telling your employer the truth make up a white like like you have been a victim of identity theft. They are not going to serve a court summons to your work

It sound to me that the debt validation is bogus. Send them back another letter telling them that the amount being charged is illegal in the State of Ohio and the numbers are made up and do not properly validate the debt. Tell them to cease communication with you by any other means other than the postal system. Below are the laws of your state and what they are permitted to charge.

I cannot believe that this website has a link to an online payday loan company at the top of the pages! UGH, the sharks are everywhere you look! I just saw an ad for Advance America on the side of a city bus that passed outside my office too. Jeez, they are total scavengers (just my opinion).
