What can I do about SIMMS Associates running a request for credit on my behalf. I found an inquiry as a result for applying for credit on my TransUnion report. I would think that this is highly illegal since I did not do apply for credit and I have not applied for credit since I refinanced my mortgage last year. I would like some advice on how to really stick it to them. I know that they are a collection agency not a credit company.

Many times collection agencies will run a credit check on you to determine how well off you are so they can get an idea how likely it is that they'll get you to pay.

However recent legislation enacted only lets them run credit checks for collection accounts where credit or a type of loan is involved.

Are you sure they tried to apply for credit, or did it just show up as an inquiry?

It was in the inquiry section and this is the exact wording, "An inquiry indicates when a business, usually a lender, has checked your credit. The inquiries listed here are the number of times in the 12 months since the date of this report that a lender has checked your credit at TransUnion. These inquiries appear because you applied for credit with the listed company. Inquiries associated with applying for new credit are the only kind of inquiry that may hurt your FICO???? score."

I posted a question on 12-31-07 in the other forum subject on SIMM Associates. You were kind enough to respond and told me I should send a "Cease Communication Letter" letter. I am not sure of the format but I am going to send them one as soon as they send me a letter and I have their case # and address. I hope it happens soon. I am in and out to sea often as I am in the US Navy.

A quick resolve divorce in California for those who have not been married for more than two years does not require it to go to court. However, you were telling me in the other topic on SIMM Associates that the SOL for CA is 4 years. I don't think that have a leg to stand on or do they?

Is it common practice for your agency to sue on time barred debts and hire attorneys that perjure themselves on civil complaints? I viewed a copy of the original poster's complaint/summons and it is full of holes. You may wish to inform your superiors to be more careful of who they choose for their legal council.

i had been making payments on an account and due to some fradulent activity on my bank account so i had to get a new bank account set up and i was advised not to let any agency remove money from my bank account, i was then trying to continue making payments to simms on a regular basis they have refused to give me the mailing address? they have called my job and spoke with my boss regarding my personal bill, i am livid and would like to take legal action, if not how can i get my bill paid to the credit card company without going through credit agency?
