Second-They tell you they are starting court process and you must show up - well why pay when you are going to have to go to court.
3rd-You go to court and have no bank account and the judge orders you to pay and you have just lost your job and have no savings-why must you pay
I have my daughter who has told everyone of her bill collectors she is filing bank rupcey and they all tell her it is a bad idea cause her credit will be screwed-it is already screwed and for her she doesn't care ,she bought a car straight out cash a used car through a private seller and she found someone who is letting her rent thier home as long as she pays 2 months in advance every month .She told me why should she pay any of them if they take her to court she has nothing and by the way her dad let her register the car in his name. How do you get a person to pay when they have nothing and credit is already shot?

What state does she live in???They can garnish her wages.Unless she live in SC,NC,TX,PA these are non-garishment states.

Also, if she gets a judgment on her, they can continue to renew the judgment until it is paid off! SO you see this can stay with her for a long time and I'm guessing she is still young at this point but wont' there come a time where she may want to own a home?? I mean paying cash for everything is a very good idea but can she save up enough to purchase a $100,000 or more home?!
It's always good to have "some" credit!

But if she files bankruptcy....well, be careful they have new bankruptcy laws. That is a rough situation and sounds like she has some enablers.

If her debt significantly outweighs her income then she is a canidate for bankrupcy. There are new laws that now protect creditors to an extent so they they don't lose their entire investment into that person.
They get people to pay either now or later by punishing them. They get judgements, leins, garnish wages.. ect..

First of all, if you pay your bills, eventually you can clean up your credit. If you go to court, there are judgement, garnishments, etc. If you don't own anything, and don't work, they still make you pay the bills. I had a client in the same situation, and the judge gave him 60 dayd to get a job, and start paying on the judgement. It's better to take care of the bills you do owe while you are young, and get your credit cleaned up before you geet old like me and start doing it!..KAren
