My husband started getting phone calls from an attorney's office that claims that he owes $3987 on a credit card. When we asked when the card was taken out, he said May 2001 and gave the address that the card was mailed to. He even said 3 total payments were made on the account and then nothing happened after that.

We told him that my husband didn't live at the address at the time and that he couldn't have taken out the card. They were wanting to open a case, which would press charges on the person that took out the card. My husband has 3 kids with his ex and didn't want to do that...but she claims that she didn't do it.

Her father lived with her at the time and stole a gun that my husband left there when they separated (he left some items to come back and get and when he came back, the gun was gone). He said he put it in his truck for safe keeping and it was stolen out of it...my husband doesn't believe him.

What would you do?

I would go ahead with the investigation and press charges. Whether it was his ex wife of her father, they probably messed up his credit score and im guessing this is a big headache. Whichever obe it was will come out in the end. There is no excuse for straight up stealing. if he doesnt go through with it, he will most likely be stuck with the bill for whatever they bought and kids or no kids, thats not right. Whichever one opened the card and set up the direct tv knew what they were doing, and that is trying to stick someone else with the bill. Go ahead and se it through. if you dont, there is no telling what else will pop up in the future.

File a police report for ID Theft and go to www.ftc.gov and fill out the FTC IDT Affadavit. Pull copies of his credit reports at www.annualcreditreport.com and see if there are any other fraudulent accounts or inquiries listed. Send copies of the above and proof of ID to all 3 CRA's. They must peramanently block all accounts and Inq's you identify as being a result of IDT. Also, send the police report and IDT Affadavit to all creditors.
