Can they call my boss?

I had a storefront payday loan and today they called my boss. I don't ever believe I gave them my boss phone number but I question the guy on the phone. Why wouldn't you call my office # and he said someone answered and they don't know who you are. I asked what number did you call and it was my direct line #.


Most store front PDL stores have a notice on the application for the loan that allows for contact with any person or company listed on the application for a loan, so if you listed your employer they can by law call your employer. They probably shouldn't but they can.

I don't think they have any business doing it either. I don't see what they are looking to accomplish besides embarassment. I don't know if it would be a violation of the fdcpa if it's not a third party calling...but I don't know that much about the FDCPA. I think I have heard it say that it only applies to collectors. Or maybe it depends what they SAY to the employer.....

EXACTLY!!! Very good point. Nationwide Cash thought they were pulling something over on me by calling and asking for my boss's fax number so I gave it to them...but that is the fax number for the whole office and I just went back there and got it off the fax machine. They sure wouldn't have gotten very far if I did get fired for it.

Ryan-would you mind telling us what company it was that called your boss and what they said?

Luckily I told my boss last week that I was working with Town and Country because I got myself deep in debt. She was out of the office and she said she deleted the message when they said they are so and so from 1st Choice Cash Advance and we are looking for Ryan. The thing is my cell phone is currently off and my cell phone is my only number besides my direct # at work (don't have a land line anymore). So I called them up and told him don't ever call my boss and to call me at my work if you are looking for me so bad. The people I listed as references never received a call and I never put my boss's # on the application, just her name. The thing that gets me is he said he called my work number but a lady answered the line and said she never heard of me before. I asked him what # you called and it was my direct line that I have. Wouldn't they call my references first if he was looking for me so bad? I gave my brother as a reference and it was even listed as brother on the reference. I just don't like them finding my boss number and saying they are from 1st Choice Cash Advance. Luckily she's cool about it and told me she would hang up on anyone looking for me. Is this any kind of violation of collecting on debts or anything?

Ridiculous....well I have not been so lucky either. Cashnet USA called my mother in law yesterday and Payday Avenue has called her a couple times too. Ryan, I am glad that you have a cool boss. I do too, and she called DMS Marketing and told them not to ever call me at work again. They are just trying to use this as an intimidation factor...embarass you into paying....stupid if you ask me. I am so over these pdl places.......

OMG I know!!! What a waste....I look back now and I see that I could have done some other things to keep from getting pdl's. Things that seemed like emergencies at the time, I could have figured something out. Personally I wish that they would all close down so innocent people wouldn't get taken for a ride by them. Honestly, once you get one there is no way out unless you are really coming into some money because the money you have to pay back is money you need to pay bills....and I especially wish the internet ones were stopped!!!!! I am so sorry I ever got involved in them...but then I wouldn't have found this place so maybe it was fate...I have learned so much here beyond info on pdl's and have met so many nice people.

I know it sucks, but on the app. didn't you have to state where you worked? They could have just called the main number and asked for the name you listed as your boss on the app. Are you in default with them? Because here if you default and don't contact them they will come to your work or house looking for you. They can and will call your employer to see if you are still working there. Heck we have direct deposit on our checks and I had made a payment arrangement with one company and he was waiting at the door of my bank before it even opened and cashed the whole check. I had called his boss and come to find out he did this to a couple other people on the same day but never turned in the cash to the store. He was fired on the spot because he didn't follow the arrangements. So I guess you should be lucky you don't live here lol. They would be waiting for you in the parking lot when you got done with work.

But if you tell them not to call your employer because they don't allow calls except for an emergency I believe they are supposed to follow that.
