Creditors Exchange claims to have a judgment against me – what to do?
Date: Thu, 08/17/2006 - 14:36
There's nothing I can do but pay the $11G right this minute to avoid further charges.
After speaking with husband, we believed we closed all of our chase credit cards and are not aware of more out there. This could be a case of identify theft.
Can I ask for a validation? And will that stop any judgements that might be pending?
Thank you
very new at this and sick to my stomach

They're part of the LVNV / Sherman family, and crooked as the day is long. I've dealt with them myself, as have many folks on this board. You definitely want to make them prove everything up front. Letter to them, too.

Certified Mail, Return Receipt Requested. If you aren't sure what forms you need, just go up to the Post Office window and tell them what you want. They'll give you the correct forms.
You'll get the green card [return receipt] back in the mail in a few days. Keep it in a safe place with a copy of the letter you sent. That's your proof, and you just may need it later.

And stop dealing with them through any medium other than the mail. Send the letters, and we'll go from there. You're still entitled to validation before you pay them anything.
Creditors Exchange Calling Neighbors
Creditor exchange keeps calling my neighbors to leave messages for me. My neighbors are elderly and I can't belive that this is legal.
Is it?
Creditors Exchange
I received a call from creditors exchange today requesting 9500.00 or legal action and I need a valid mailing address to send a validation letter. Please help because the address I received was for Buffalo, Ny and I cannot validate it through the white pages
Creditors Exchange harrasment
I set up payment thru Care one for my Bank of America card, which is a lawyer that gets paid first, and them my credit card. So when the Creditor Exchange guy called, he threatened me with court proceedings,(there are none) and now is calling my father in law (different phone number) also harrassing him. I told him what Care one said to say about to contact them for info on this account, but he will not listen and says he can no deal with them. Please tell me how to get him to quit calling and harrassing me at work and callling my realatives. Thanks
This is insane!
First of all NO one can collect on a debt until they prove to you, in writing (Original copy) that you owe the debt. You need to have them send you proof, othewwise quit talking to them. Secondly, if they are calling neighbors and such you can sue them for harassment! If they claim you owe yet are not willing to take some type of payment arrangement let them take you to court! My mother did this with a $10,000 credit card bill and the Judge threw it out becasue they could not provide original paperwork! Neeldess to say, they have left her alone ever since and the Judge said she missed her calling.
If they calim they are an Attorney you need to get their name and state they are registered with and if you can't find them with the local bar assoication you can sue them for falsificaiton. They CAN'T claim to be an Attorney and are not one, it is ilegal.

This is a good point so if you can get a recording of them threatening you as if they are a lawyer and you can prove otherwise that may make your case.

I did have a surgery , this is more than a year, i was on deshability for all those times. But i was able to pay little bills and rent.i couldn't afford to make some payments on couple credit cards with high balances. Now iam out of deshability without jobs, and the creditors exchange called me and said they will report me to the county and i will face some big consequences and i will be arrested.Because they said i have been paying my rent and others bills. What should i do ? What is really their option if i can afford to pay those credit cards bill ?

FALSE... THEY CAN REQUEST A BENCH WARRENT AND THE JUDGE CAN ISSUE IT BUT THEY HAVE TO PROUVE THAT THEY HAVE EXHAUSTED EVRY OPTION.
But yes you can sue for harrasment. By the fdc laws they CANNOT threaten you with legal actions. They can only inform you of what there next course of action will be. If they have no intention of doing such than it becomes harrasment. The best thing i can sudgest is get a digital recorder and start recording the conversations for proof for if they file on you or you sue them. I dont know if you have to inform them that you are recording but i would just in case if you do sue.

IMO that is true if the defendant fails to appear before the court even after being served with the summon by the sheriff, personally. If the bench warrant is issued the sheriff can then arrest the debtor to produce him before the court. However, it is not issued because the debtor has failed to pay the debt but because not appearing before the court even after receiving the summon is considered as contempt of court.

While it is *possible* to get arrested in relation to a debt, as I have stated before, it is *extremely* rare and usually involves an open Contempt of Court. Usually it is only used for people that OWE the debt, have the money, but flat-out *refuse* to pay it and actively shuffle their money around to hide it from the law - not to mention, when I have seen the rare instances it involved a *lot*of money - like millions of dollars.
So methinks there is more to your story than you are telling.

mex, youre really beginning to make me believe that you either do not know at all what youre talking about, or that you are here to intentionally spread false information. Here, let me help you out, again.....
A BENCH WARRANT can ONLY be issued by a judge during a court proceeding. Why do you think its called a BENCH warrant, folks? because it is issued AT THE JUDGE'S BENCH. This happens when you are supposed to go to court and you do not appear. Normally, a bench warrant is not seen in civil cases, because the very nature of a civil case means that it is not a criminal matter. Typically, if you dont show up for court in a civil matter, the judge finds in favor of the other party instead of issuing a warrant for you. Keep this in mind, the only other way for an arrest warrant to be issued is for the police to get a judge to sign off on one. A BENCH warrant happens because the judge issues it, not because the debt collector gets one done.
One thing to really consider here though, mex, is in your posts. You ALWAYS talk of "personal experience".....let me share with you some of my personal experience. I began working in bail enforcement about 8 years ago. I went to college for criminal justice. And I have helped dozens of people on here and elsewhere to get out from under scavenger debt collectors and illegal debt collection tactics, including numerous court cases. And in all my "personal experience", too many coincidences add up to no coincidence at all. This is the second post from you I have seen just this morning that relates false info along with your "personal experience" to back it up. You claimed elsewhere that a clerk in your office filed a lawsuit against someone, and yet in order for you to work in the kind of office that would be involved in such things, you have incredibly horrible grammar and spelling. What, do you work in the mail room or something?
Bottom line, your "personal experiences" are false. The law simply does not agree with your "personal experiences". Unless, that is, you simply happen to have the repeated misfortune of living and working in a place that throws the law out the window every time you are "personally" involved.....

This is, again, false. They CAN inform you that you can be sued. They CAN tell you that they will sue you. They CAN. The only time they cannot is if they threaten to do it and then dont do it. They can tell you ANYTHING as long as they have the legal right to do it and as long as they really intend to do it. Go read the FDCPA for clarification.

I talked to some guy bu the name of Faival Khan, I could not understand him either, then he connected me to some rude woman who thought she was really something. I have attained a lawyer and he said I was not to pay one dime. I haven't had a credit card for three years, so there is something not correct with this picture.
If the bill isn't yours don't pay it. He told me how low the crdit card company would go for me to pay off a bill that isn't mine and Ifound out that they would go much lower than what he said, and I'm going lower on what I pay because I didn't run up these charges. I cancelled that credit card 3 years ago. Somethings rotten in Denmark.
How do I stop their phone calls
They pulled the same scam on me. However, can anyone out there tell me how to get them to stop calling me and harassing. I'm not working because I have been diagnosed with chronic pancreatitis and can't work, and this harassment is not helping me out at all. Thanks
