Need urgent help -a law office is threatening me with intent to defraud

I'm writing to you about some payday loan trouble I am in. I have talked to several attorneys in my area who haven't been of much help to me and I don't know what to do.

About 3 years ago I defaulted on a loan with payday services for 500 dollars. I was contacted by a group called Credit Recovery Services in 2008 on the behalf of payday services who demanded payment or be served with some sort of legal action, so I gave them the 565.00 they wanted. I thought the matter was officially over and I could get on with my life.

The real problem began last week when a woman named Ms. Silver, claiming she was from the Law Office of Mark Carey (Williamsville, NY I think), called my mom and my brother. I then took the call and she told me that she had something from the county with the intent to defraud if I didn't pay them. Their office wanted 1,565 dollars to collect on behalf of payday services. I then faxed her the paperwork I had from Credit Recovery Services showing that I had paid 565 already. She called me back and said the information was wrong and that she had a different account number from payday services. I told her that I only took out one loan with that company. I then got really scared, afraid of going to jail, etc., and gave them my visa card number. They are supposed to withdraw 500 tomorrow (Feb 10) and then the remaining balance on the 25th of this month.

I have honestly never been so scared in my life. My medical job requires me to have a clean background at all times - I felt like I had to pay these people what they wanted just to get them off my back.

After doing some research online, I noticed there were some people in similar situations who were also contacted by the same law office and said it was a scam. I don't know what to believe - is it a scam?, am I a victim of identity theft?, did payday services not receive their previous payment from Credit Recovery Services? I cannot afford to pay this payday loan twice. I'm so confused.

I am in desperate need of any help/advice. I'm so afraid of going to jail for intent to defraud/bank fraud/etc. Can't eat or sleep right now.

first take a breath.now payday services is an illegal online pdl.that being said,you only owe the principle borrowed.anything debited goes toward the loan.also this place is a bottomfeeding scum.debts are civil matters not criminal ones.the fact that they threatened that makes them as bad a the pdl.how much was borrowed from payday services?first i would file police reports for the threats.they will also tell you this is a scam.then file AG,and FTC complaints.then tell this place to pound sand.do not give them a dime.do not speak to them again.if these clowns call your work hang up immediately.i had this illegal pdl and they debited 325.00 on a 275.00,and claimed i still owed 325.00.i filed the reports and complaints,and they disappeared.you should do the same.

If you have their address, send them a certified, return receipt letter stating that you do not owe this money, and that under the FCRA you are disputing it and are requesting validation of the alleged debt.

Request that they provide you with copies of paperwork proving that you are the obligor; copies of payments credited to the account; proof that statute of limitations has not expired; proof that they are licensed to collect in your state and proof that they have been assigned the debt.

Include in your letter a statement that they are NOT to contact anyone other than you, and in writing, regarding this debt. This is called Cease & Desist.

Thanks so much for all of your wonderful advice. I have indeed called the bank and canceled my card.

Just a few minutes ago I found a consumer attorney in my state who has a lot of experience with these matters and was very familiar with the illegal scams in the Buffalo area. I'm meeting with him tomorrow.

My question is why did they tell me they have legal documents from my county pertaining to fraud or passing bad checks? Is this some sort of sick scare tactic? If they don't actually have that information, isn't that illegal on their part?

I just thought of something else. As I have canceled my visa card that they were going to use to withdraw funds on the 10th (tomorrow), what will they do next? My attorney appointment is at 2:30pm EST - an hour's drive from my area, and if the so-called law office/collectors call before then what do I do? I don't want them to call my brother because he is extremely upset with me that they called him in the first place. Should I answer the phone if they call? What if they tell me that they have something from my county again?

Explain to your brother that this company is acting illegally and that if they call him, to immediately inform them to not call him again. Tell him to hang up on them as you can't control them calling him anymore.

They will probably try to scare you further by claiming you defrauded them by freezing the account. If you do talk to them tell them that their method of obtaining payment information was illegal and you have every right to freeze your account. Tell them that you know everything they have said is BS and they are more then welcome to 'file' anything they want as you would love to see them in court and have them explain their illegal tactics to the judge, that in fact, you have an appointment to speak with an attorney and they might be seeing you in court weather they like it or not and to trust you, they won't like it one little bit.

Or, you could just hang up on them every time they call.

Oh things got even worse today. As of right now, I am absolutely terrified. A guy by the name of Frank (calling from an 800 number this time) called my mother and said "he would be in the area for her to sign documents" tomorrow. I am scared out of my mind. I fainted in my mother's living room about an hour ago. I have never been so scared in my life. I'm having chest pain and I'm only 31. This was just minutes after I talked to the attorney - he hasn't had time to get all of his paperwork together. OMG what am I going to do? It is too late in the evening to call the attorney now. I have to work tonight but I don't think I can. I want to go to the emergency room but I have no insurance. I'm in tears right now and throwing up as I'm typing this.

do not be scared, please do not let them get to you. they are not legal and all they can do is threaten you.
seriously, start avoiding their calls and advise your family to do the same. they cannot do anything to you.
the reason why he hasn't had the time to get his paperwork together is because there isn't any for him to get together. they are full of it, saying things to scare you.. do not call an attorney, go to work and avoid them. they are doing this to scare you and it sadly is working. they are not worth risking your health for... i was scared like when i came. i got the same threats, everything. and you know what happened to me? nothing. you will be fine, be strong.

Thanks for the advice. Up until now, I felt like I was all alone.

I just cannot believe someone would threaten my family like this. So what you are saying is that nobody will actually going to come to my house at 3:00 p.m. tomorrow? Is this just another scare tactic? It sure has worked.

I just want my health back and for them to leave me alone. I do wish there was some way for these people to stop contacting my family. If they want to threaten me, fine, I'll take legal action myself. Just leave my family out of it. The sad thing is my mother is already involved because she has been harrassed also. I feel like I'm a total discrace to my family right now. I could kick myself in the rear-end for ever taking out that loan.

Seriously, these people cannot do anything to you. Just him telling you what he did, is sufficient to justify suing the pants off him. And he knows it as well as I do. That's why he won't give you a mailing address. Because he doesn't want to get served.

He's not going to show up on your doorstep, either. If he did, simply call the local police and have him charged with trespassing.

The physical symptoms you are describing are consistent with a panic attack. What to do... Stop letting this criminal push your buttons! Really. It's just that simple. He calls, you hang up. He'll get the message after a while. Got an answering machine? Use it! You are not required to talk to this guy!

Listen to me. When Bea first arrived in our community, she was a wreck. Seriously. I almost gave her up for lost. Look at her now. Nothing happened to her. Listen to us. We know what we're talking about. And we know what you're going through.

good stuff by ubc,and bea.now you should have your mother file a police report as well.also see if she wants in on the lawsuit with the attorney.the more the merrier.also what unc said is true,you cancelled their fraudulent payment.now they are gonna go over the top with the threats.now since they are calling family.i would once you get with this attorney,see if whoever this mutated garbage calls wants in.have them file police reports and give depositions.do not beat yourself up,or put yourself down.you did nothing wrong.this piece of illegal collector slime is breaking the law hand over fist.make him pay.please try and remain calm.however if you feel like getting pissed off go ahead.because that is how you should feel not panic stricken.just know that everything that comes out of their pieholes is a lie.

These people started calling me almost 2
weeks ago and they call my work and leave
messages with clerks. They have had me so scared!
I've asked verbally for them to stop calling and to send
out verification of debt. They still call and state they
can only email or fax. They leave messages that if I
don't call by end of the day they are seeking letigation and
sending papers to my home and or work place.
