customer agreement a scanned misaligned and had print running up the side of the page to i guess fit it all on one page lol.but he is calling this my contract, well i am no lawyer but a contract has to have a signature on it and even a date?
he sent a ledger card to prove the amount of the debt
to capital one bank but i do not think capital one is at a new york address that when googled is a collection agency. lol
i kinda feel he outsmarted himself in his legal brain power for words.lol

James be very careful in court with Cap 1 as they have a nasty habit of burying a court room in paper with more than enough for a judgment. Also realize in certain court jurisdictions a contract is not required to show it is your debt because billing statements from them will show who you are,where you lived,and that you used the account.

i am very cautious cajun,i have learned to by talking to people and reading on the net bout tatics that happen.it amazes me that even alot of the judge's are not up on consumer protection acts and let attorneys do as they will.cap1 is pretty bad from what ive seen and heard,but one thing that still gets me is ledger card that was in the papers i got it has no itemized listing of moneys it has a balance and then interest and fees. then it has like a few balance categories with those to listed again and a total and the dates and fo acourse filing fee and attorney fees and has a listing that has a - 5,672 yes a minus sign before it then a total out beside that of a postitive amount
.up top it has the plantiff versus me and my address
but the plantiff cap1 has the addy of a new york collection agency.no billing statement i have seen is a orginal copy from cap1 it is a copy i believe of a 3rd party.and the attorney also gave me a business card and sad if you want to pay make checks payable to that on the card which is his collection agency that he has besides attorney office,why not say make it out to cap1 or even this collection agency in new york? and when i mentioned the new york agency he asked had i talked to them and seemed stunned.he is trying to hide the fact that this collection agency in new york is independent from cap1. i wondering now if cap 1 has not sold this debt,
