DCS nightmare

:confused:I recently set up a payment arrangement with DCS for their rehab program. I've been paying them for a few months now and when I set up this agreement I was told that since payments were being made that my wages wouldn't be garnished and my taxes wouldn't be touched. Well I just checked my refund for my taxes and found out that all of my refund was taken due to a flag on my social security number from DCS. Not only was I told that this wouldn't happen, but they also told my mother the same thing. I was counting on that refund for my down payment on my car and now that money isn't there and the down payment is due in 2 days. My question is, is this legal for them to do when they specifically stated that this wouldn't happen? Also is there a way to fight this? I have been making my payments to them on time every month.


DCS doesn't file the offset...your guarantor does.

Legally they are entitled to offset your taxes since you are in default. However, each guarantor does lay out a set of criteria to be removed from the offset. All require that you be in voluntary repayment by a certain date...usually sometime in november. Some guarantors simply require a single payment, others require 3. Others require a certain amount be paid. Requirements can change yearly. You will need to call DCS and ask them. Keep in mind they have no control over whether or not the lein is placed...or whether you get your money back.

When did you start making your payments?

Really you should not be spending your tax refund until it hits your bank account.
