I didnt pay a tow truck company and they sent the debt to a collection agency The collection agency is trying to take me to court to see what the judge will say ..(tryng to do a settlement through court) Do I HAVE TO GO TO COURT? WHAT CAN I DO TO STOP THIS..????

Ejay,
I split your post into it's own thread here. We would rather each subject be on its own than to bring up new topics within the same thread.

JCEMT is right, we will need more information. What was the tow for? (ie did your car break down and you had them tow it somewhere -- or was it parked illegally and removed?) Did you get the car back or is the tow company still holding it?

You can try to contest it, but if the collection agency is collecting on it but does not own the debt then it will probably be easy for the CA to provide appropriate documentation in court. You do have to answer the summons if you are going to try to fight it as your absence will result in a default judgment.
