My wife got a call today from this company allied interstate saying they where collecting a debt for Sears. In fact we had a Sears account 8 years ago. They wanted to set up some kind of repayment for $900.00 with $100.00 taken out of bank account for the next three months. Then pay the rest in full. She gave the are account number but i think the SOL has run out on this debt. What should i do??????


Allied Interstate is well known for trying to collect on expired debts. Send them a certified letter asking them to validate the debt by providing the follwing info:
How they arrived at the amount you owe
Proof that thet are legally allowed to collect the debt
The date and amount of the last payment made on this account.
Proof that the statute of limitations has not expired.
Also include a cease contact paragraph stating that they are not allowed to proceed with collection unless the debt is competely validated. Also that they are to contact you through the US mail only.
You might get a feeble attempt to validate it but probably not. The are a large agency with a big turnover rate with poorly trained employees. They have been describribed as a class action lawsuit waiting to happen. Do not agree to pay them anything. They are bottom feeders and wil tell you anything to restart the statute of limitations. What state do you live in?
