Ok I will post this update for my LVNV thread but I have a big question about it. Went to court today, a default hearing. The judge apparently didn't know the finance code and I just happened to have a copy of some of it (only brought for my own notes- didn't think I would need to show the judge). Anyhow he said we technically win by default, but he wanted to take it under advisement and look up the code himself and make sure we could bring civil suit for this. :) I know we can, but he could technically award anywhere from 100+ per violation and it also has criminal penalties up to $500 so we asked for $500 each figuring LVNV would rather pay then be guilty of a misdemeanor.

Anyhow the judge told us that even if we got the judgement for the whole amount, we have no way to collect it from LVNV. Ok...so I never thought of that..so now here is my BIG QUESTION:

I get this judgement...how do I enforce it and make LVNV pay?

The judge just mentioned "How were you going to collect from them?" He said he didn't see how we could. But heck...there MUST be a way, otherwise why would so many people sue and win?? I guess I could take the judgement to a CA and let THEM go after LVNV..heh irony eh? Or a lawyer and go back to court to levi thier bank account?

No idea how we will go about collecting once we won.
