It appears that Lvnv has received a default judgement against me in the state of TN re: a delinquent Sears acct from WA. state, DOLA of 11/22 according to my credit report. The judgement entered was 10/22/08. Now I've been subpoened to court to give testimony and present proof of income, (taxes, pay stubs, bank statements, etc.) property owned (land, vehicles, etc.) what rights do I have or have I pissed them away. HELP!!

David.

I live in TN now, since 2004. Evidently I was served, and you know; I recall going to the court on the date shown on that summons, but on the day the hearing was set for, As I recall, the courthouse was closed. This is a small county, and here in Tennessee all the businesses (I think Statewide) select a day during the business week to suspend all activities, As I recall that was the situation. Crazy huh? Regardless the County Clerk shows there was a Judgement filed against me. Whats a guy to do Right? Do I have a defense? I contacted a local civil atty and he said that if the judgement was entered in 12/2008 then because the DOLA was in 11/02. With a 6 yr SOL, the judgement is binding and will have a 10 yr. window. I have been far too passive w/regards to my legal issues I know, and partly because I feel so intimidated by them. I know that ignoring them is Ignorant, however the sentiment remains.
