motion to set aside default judgements on temprorary orders ruling
Date: Sun, 05/10/2009 - 09:08
In Texas, my wife and her attorney missed the temprorary order hearing. the judge awarded me the kids, wife pay child support, and get to establish the primary resident of the kids.
Recently, I recieved a motion to set aside default judgement from the opposing counsel. The request states that she was in another court and my wife was in the hallway. She indicated that she informed the court prior to heading to the other court.
In the judge notes she clearly outline the attempts made to contact the opposing counsel by calling the other court which indicated that she had left, called her cell phone, etc.
What is the likilihood that the motion to set aside default judgement will be granted?
