Asset Acceptance Continuing Collecting

I have been dealing with AA for several months now and am not getting any resolution. I first sent them a letter in November requesting debt validation. What they sent me was a piece of paper that says debt validation at the top, lists the creditor name and original amount, fees, and balance. I had requested that plus other items for example that the statue of limitations has not expired, the original contract, and that they actually own the debt just to name a few. I sent them another letter in December requesting validation again with no response. Then in January I received a settlement letter that they would discount the debt by 25%. I again sent them another validation letter referencing the previous two letters. Yesterday I received another settlement letter that they would settle for 50% off the original debt since it was tax time. I am not sure what to do next because they did send some type of validation in November but they have continued the collection process after that even though I have sent them other validation letters. What should be my next step? I know someone on here will have the answer. Everyone here is always so great. Any help would be appreciated.


That was not validation, heck it sounds like it was typed up on their own letterhead. First, validation MUST come from the OC and then forwarded to the debtor. It has to show your contractual obligation, what fees and/or interest is legal, the ownership of the debt, if the CA is legally able to collect, etc.

The fact they have not provided validation and continued to collect are violations, you can take them to court over them. Those settlement letters are directly in violation as they are considered collection activity.

Try sending them an intent to sue letter, in it state you do not appreciate their unlawful activity and refusal to provide you the proper validation they by law must provide. Inform them that they had better cease all collections on this account and remove the item from the credit reports..(are these things on your reports?) or you WILL take them to court for the continued collection activity with is $2000 I think.
