Please help w/cc lawsuit.

I've been sued by Discover Card and the lawyers want me to pay $400 a month which I can't afford. The lawyers have asked me for proof of Hardship. Copies of all my bills and pay stubs, including a letter stating what I can afford to pay monthly. Should I send them copies of my bills and pay stubs? I'm afraid they may use this to garnish wages or put a lien on my house. What should I do? I live in Illinois. Thank you in advance.

A collection agency can never garnish your wages unless they sue you to the court and bring judgment against you. If you cannot afford to pay $400 per month, you can send them the proof of your hardship in order to avoid judgment, as judgments lower your credit score. You can send copies of your bills and pay stubs but make sure that they do not have any confidential information like your social security number.
