How to dispute fraudulent debt from collection agency

I received a collections notice in 9/2008 for a cell phone bill dated 11/2005. The cell phone company suspended the acct in 11/2005 I sent the CA a debt validation ltr and the collection agency sent me copies of the bill with my name. I have never owned this acct. I believe my identity was used. The collections agency is now giving me 5 days to discuss repayment. HELP!


30 days from receipt of the first dunning letter is the timeframe per fdcpa. File a police report and send them a copy of the FTC IDT affidavit. Inform them that if they pursue this matter, then you will have no choice but to file suit against them. Once they recieve the IDT paperwork, they must cease collections. Also send the paperwork to the OC. Have you pulled your credit reports? www.annualcreditreport.com If there are any other fraudulent accounts or Inquiries on your reports, identify them and send the police report, IDT affidavit and proof of ID to all 3 CRA's. Make sure you have a fraud alert placed on all your reports as well.

FYI...when I was in collections, we had some pretty crappy skiptracers. They would enter the first name match without verifying which could be the case here. Not ID theft but lousy skiptracing. Definately check the credit report but if the OC has a common name, I would be talking to the CA first to find out where they got their info from.
