Ok, so my daughter has settled and paid with money order a medical bill back in May. I disputed the entry on her report with the bureaus... they came back and left it as remains so i in turn sent them ALL the paper work between her and the CA along with copies of payment and PIF letter. It is STILL on her report! It's been over 2 weeks now!
Do we wait a little longer or what's the NEXT step to getting this updated as PIF as we agreed upon?
I'm getting annoyed, had she just NOT paid it, it would have come off in a year! Grrrrrrrrrrr
thanks for any help,
ANg

Hi Ang--

ok, once a dispute is filed with a credit bureau, they then notify the creditor of the dispute. That creditor is then given 30 days to respond. If the creditor does not reply, or if they cannot prove that their data is correct, the credit bureau must remove it from your file. Once the CB gets results on the dispute, they must notify you to let you know the outcome.

The good news there is that you have provided documentation from the creditor. Here's the thing now--under the FCRA, if your report is not changed to reflect the true standing of this account, both the creditor and the CB will be in violation of federal law and you could be entitled to damages. you did everything right on this one, the only thing left to do is wait for the answer. Let us know what they respond with, and hopefully this takes care of that account!

The bureaus will investigate the items in question directly with the information provider be it creditor, collection agency or courthouse. They will forward all the relevant information you provide regarding the dispute to the organization that provided the information. After the information provider gets the notice of a dispute from the credit bureau, it again examines and reviews the data provided by the credit bureau. After the information is reviewed, the information provider reports the results to the credit bureau. The credit bureau will then respond to you by mailing you the results of the investigation. Usually the bureaus take around 30 to 45 days to notify you the result. So, do not worry.

Ang--it doesnt necessarily take them that long, but the 30 days is how long the creditor is allowed to respond. Sometimes they never respond at all, if that happens you need to push the creditor and the CB to delete any and all references from your credit report. I say to push both because if you only push the CB, the creditor can resumbit the info to your credit file later on.

I don't get it!! They harass and harass my daughter then we send a dv letter, it's validated, so THEN we send a settlement letter and they counter offer and we accept and send payment immeidately!! THEN, they don't cash the money order? And i KNOW they recieved it cuz it was sent return receipt!

Ang--the best thing you can do at this time is contact the creditor directly. Inform them that they agreed to a settlement with you, and that you paid them. Tell them that you sent the payment via money order, CMRRR, and that you can prove both that you bought the money order, and that they received it. At this point they are the only ones that can tell you anything either way about this. One more thing--if they try to pull some crap about "we dont have payment so that settlement is now no longer available....", be sure to stand your ground. You can prove that you bought the money order, you can also prove that it hasnt been cashed yet, so they cannot claim you only did it, then cashed it in yourself. Right now, it may not feel like it but you hold all the aces. They need to investigate and find out why they have not applied this payment to the account. Dont worry, this will all work out. Keep us updated.

Ok Sky i'll try to give them a call but what i don't get is.... i KNOW it got to them before the date they gave me. Why would they NOT cash it??? I mean it's NOT like they gave me this huge discount! Took 50 bux off! Whoopie!
I need to settle down over this before i call them also, cuz dont' wanna say something in anger! Figured i'd be over it by this morning, but i'm NOT!
Do these CA's "really" wanna get paid?!?!
Doesnt' seem so to me and i was thinking of calling the hospital that hires this CA and let them know what's going on!!!

Well well well, go figure, i went to post office to check on this money order and before the 10 days are up to refund my money they cashed it!!
WHY IN THE HECK did they wait this long? Now i try to get back to her credit report to see if it's updated and i have to now wait on them to send me some code thru USPS to get in! A paid report too!
SIGHS!
Can't wait to see how it's posted on her report though!
And btw.. i'm working on my patience! Always nice to have more virtues! :)
