What happens if you send DV to CA after 30 days from receipt.

I received the notice "Intent to Sue" a month after it was sent because it went to my former address. I sent a debt validation letter but the letter was sent on 1/28/09. Do they legally have to respond even though it's over 30 days.

if it has been more than 30 days, they do not have to respond and do not have to cease collections. They can file a lawsuit at that point. It does look good however that you did send it if they do sue you.

I believe the date starts from your receipt. Not the date on the letter. Keep the envelope showing that they sent it to the wrong address and possibly have a copy of your lease/mortgage to prove date that youy moved in.
