If you send a DV letter to a CA in the 30 day time frame you have to dispute after you receive their letter, can they still report it on your credit report?

Didn't the FTC rule that any reporting was considered continued collection activity? Therefore, if the account wasn't reported before they got the DV and they decided to report it after they got the DV but before providing the validation, wouldn't that be considered continued collection activity?

I just wonder because of the one-two punch..if the CA verifies a collection account, it is considered continued collection activity, so wouldn't reporting a previously unreported account after a DV request has been made?
