My original creditor charged off the debt to this ca and a lady called today and left a message stating that she had the file on her desk,along with my ss # and case #.Should i send a c & d letter?And then a validation letter? I'm lost.

Dont worry about feeling lost, we're here to help. The first thing to do is to send a validation letter. This must be sent by certified mail, return receipt. That way, you will have proof that they received it. Then, if you like, you can send out the cease and desist letter, but if you do, I recommend stating in there that you want them to only contact you by mail. Again, send it certified mail RRR, so you have a record.

Once they get the DV letter, they are required by federal law to immediately stop all collection activity until they provide you with proper validation of the debt. If they cannot give you validation, they cannot continue trying to collect on it. So, if the calls continue, or if they send you things in the mail, after the date they get your DV request, let us know.

The same holds true for the C&D letter--after they get it, they can no longer call you trying to collect the debt. So, the little green cards you get back from the USPS that show the date they received your letter, make sure you keep those.

If this CA keeps on calling anyways, and doesnt honor your requests, let us know that too--that would be grounds for you to sue them.
