Missed DV Window, What Are My Rights?
Date: Sat, 03/13/2010 - 06:30
About 60 days one of my accounts moved to a JDB, but I didn't realize or understand the process then and did not send a DV letter to the collector within 30 days.
I assume it is useless to try to send a DV letter at this point? If they sue, have I already waived my right to have them validate the debt during the lawsuit? This 30 day rule thing seems very anti-consumer, why do I only have a right to have my debt validated for a period of 30 days?

Thanks, but it appears that thread is confusing credit reporting
Thanks, but it appears that thread is confusing credit reporting with the FDCPA, thus it did not address my question. Does anyone know more specifics about my question?

Yeah, I too have missed on that.
Anyway, if we stick to the old rule :( then yeah, missing the 30 days window somehow confirms that you have agreed to the debt since you haven't disputed it. I personally don't feel that its very consumer unfriendly because if you don't agree to something, the faster you react to it, the better.
yeah but the CA sends normal mail, no signature or delivery conf
yeah but the CA sends normal mail, no signature or delivery confirmation, so no proof. Just send the DV letter.
