Yes, send them a letter saying you are electing arb, pursuant to the cardmember agreement. They may sue anyway, but then you can file motions with the court (to compel arb or to dismiss), and you will have good claims against them in arb.

I plan to send them a letter this week but Im not sure how to word it correctly or what to use as my reason for electing arbitration.Im nervous about all this and don't want to mess this up.
