I saw a post here recently concerning ESKANOS & ADLER but now can't find the thread. From what I remember, they are pretty ruthless. Is there any chance they will let me make payments on my debt or are they going to require it all at once?


Don't let them scare you. You have rights and I bet these lawyers are just acting as a CA in reality. Some scummy CAs will hire lawyers for collections because it scares people into paying.

DV the lawfirm. You have that right. They have to prove everything they say you owe. Even if they have all the documentation, you can offer a pay arrangement. They don't have to accept it, but it shows your good faith in trying to resolve the situation. Don't let them intimidate you.

I sent my DV letter & now the CA has asked for some sort of delay tactic with me & the NAF. Seems they can't come up with the DV so they want to leave the case open indefinitly. Is this legal?

Hi Carol--

I would push for this to be dismissed, as soon as possible. They cannot continue to take any action against you without providing the DV you requested. It is that simple. A lot of these CA's try to do things like this in arbitration because it isnt court, and in court you make motions for dismissal with prejudice. The important thing is that you dont pay them one penny without that validation. They need to provide it by law, and they cannot get around that unless you dont stand up for your rights.
