ASAP: what are my options?

I recently made a settlement agreement with a collection agency. The debt was for 8500, they agreed to take 7500 and submit me as being paid in full with zero balance. Problem is that the settlement price wasn't listed correctly in my debt consolidation loan/mortgage refi and the check was cut for the full amount.

I contacted the agency (Arrow Financial) and explained the situation prior to sending the check. My only real option was for them to send me a refund for the balance (we had already closed on the loan). The rep. I spoke with assured me this would be no problem, the refund would be issued 2-3 weeks after the payment was received.

I mailed the payment as I was supposed to and contacted them to let them know it was on the way. I waited 3 weeks and called back after not hearing any more out of them. I was told that it hadn't been processed. I was given to the collections manager who assured me that it would be fed ex-ed to me by last Thursday. This was not done. I spoke with him Monday and he said it would be overnighted either yesterday or today. It has not been done. He assured me that it had been handled already but apparently it hasn't.

He now won't accept my calls and I was given a message by one of his co-workers that he wasn't taking my calls because I keep calling. (hello? if he'd take the damn call I'd quit calling) I was told again to expect the check by the end of the week and that they'd call me with the tracking number. I don't trust them at this point.

I want to know what I can do to expedite this refund. We're talking 1000 bucks. It may not be a lot to everyone but it's a lot to me.

That's a good idea, Lawn. This is obviously a very unprofessional company. I can't believe a supervisor would treat you that way, guest! It doesn't seem that you have called them too much, but that they haven't followed through with their end of the bargain. Hopefully you will get some resolution to this soon.

Have you contacted the bank that cut the check? See if they cashed the check, if not have them put a stop payment on that check and cut a newe one for the amount you agreed on and then have the bank apply the rest towards your mortage. I would have done that asap and had the amount changed. I wouldn't trust arrow as far as I could throw them. I sure hope you had the settlement in writing because like stated above you can kiss that money goodbye. If this person is not taking your calls I would call and ask to speek to a supervisor or manager. I would also file a complaint with the BBB and the state they are in. Arrow just plain sucks to deal with. Thank god I never agreed to any payments to them and they sold my accounts to someone else, now I don't have to deal with them slimeballs.

As the saying goes ???????Possession is 9/10 of the law???????. In other words you have maybe a 10% chance of getting it back if the guy decides to be nice which I doubt he will. Basically your bank screwed you with that mistake. I agree with FYI that even if you have the contract in writing you would not succeed in getting the money back if they do not want to return it. You might get some results if you had his personal information so you could harass the crap out of him on his personal phone like he did with you (lol). I did that with someone that owed me money once from and ebay purchase after they wrote me a bad check and they eventually returned the item.
