So, this guy Richard called me last night, and stated that I'm going to be served today, if I don't pay $610 over the phone, wouldn't make payment arrangements. I have my debt validation letter and the cease and desist letter ready to mail. These people are so rude and unprofessional, asking me about sports situations? I'm assuming these people aren't real lawyers, but this debt is old, I'm right in thinking they can't do anything to do me today? He stated that if I didn't call back within the hour, I would be served papers today by my county, and my bank account would be closed. He stated that he had all of my banking information.


Seriously doubt you will be served. It costs them money to file, so if you were going to be served they wouldn't bother threatening and trying to wheedle money out of you that way.

If he has your banking information, and he closes your account or takes money out without authorization, it is fraud, and carries a pretty stiff penalty. Best thing to do on that front is to go to the bank and talk to them. They will either close the account and reopen another one, or put blocks and alerts on for you (so you have to show up in person to do anything, no phone or internet activity allowed). Kind of a hassle, but at least it protects your $$.

Send the letters, CMRRR of course, and don't talk to them anymore until you get your validation.

I too was contacted by a gentleman as above, He was able to give me information on a bank account which was closed due to fraud and stated that the origninal debt is 631.91 but they will settle 315.95. I asked if he was a debt collector and he stated no he worked for an attorney hired by the company attempting to collect and that if it was not settled that they would persue legal action. If I find the account is due and was returned unpaid should I deal with them..I certainly don't want to be part of a scam yet dont want to neglect a debt that could become a legal issue.

I recieved the same call today and they talked of a debt that was from 1999 that was the responsibilty of my ex-wife per the divorce decree. I authorized a credit card transaction for $5000.00 without anything but a threat of a lien on my house. I talked to the credit card company and I am filing a dispute as soon as it posts. what else should I do?

I had surrendered a vehicle back to bank couple years ago which they promptly auctioned and even after two years of payments they said i owed about 9000. bucks. about year and a half ago got call from this falzone office pressing for money. scared and uneducated about such they got a hundred bucks out of me then not heard from again till recently. then outta the blue my mom calls me telling me that these scumbags called her dropping that they needed info for case against me. again they almost got money out of me but due to finances and lack of work they pressing to take it to court. no way i can afford to pay for any of it what do i do?

I had those same calls. I called back and he told me was an Discover debt ( I never had that card) I told him to email me proof that is was mine. All he emailed me was a letter from Frank Falzone on attorney head. Thats it!!!. I wanted something from the credit card company to prove its mine.

Can they really hold a lein on my wages and etc?

So I have a $2000 credit card bill with this Law Firm. I told them I have no idea how this was created. Turns out it was my ex-husbands who filed chapt.7 bky. My name was transfered as the primary on the account. I told them I wasn't going to pay for it, ended the call and after that aprox. one week afterwards I was served with papers at my job. They won't settle now, they tell me it's outa their hands now. Now I have to go to court next month - I can't believe this happened to me and I wish I did settle the account when I had the chance. I don't want to have to go thru with this but I have no choice now. I strongly urge anybody who has a debt with this law firm to pay it or they will have to deal with what I am dealing with now.

My mom co-signed a loan for my brother and his wife a car. The loan was defaulted and car repo'ed, all without my mom's knowledge. My mom was telling me that they are calling, and being extremely rude to her saying "she didn't know who she was messing with and they would subpoena her and freeze her bank accounts."

First of all, if this is legal, Falzone is in violation of the Fair Debt Collection Practice Law. There is no paperwork being sent to her, it's just phone calls.

What is the next step here?

I received a call today. the female told me she was from Falzone. She said there was no way to make payment arrangements and after saying that I had no money she then told me that if I can give her $50.00 that she could work out a payment plan. She then said that I would have to send out post dated checks and if they return for any reason, Falzone would then turn it into a criminal court case for writing a non-sufficient funds check. She wants me to call her back with the bank info. and set up the payment arrangements for $150.00 every 2 weeks until the debt is paid off. what do I do?

What don't you people realize, you decided to get some kind of line of credit and decided never to pay it back.You are an adult like me and should take responsibility for your actions.... If you owe money, pay it! Don't make all these false accusations trying to find a reason not to be responsible for your debts.

Play games? What are you kidding me. These people are liars and cheats. Don't play games, DEMAND proof of the debt and DEMAND proof that you signed a CONTRACT to PAY THEM a dime. Lacking that tell them to shove it. You may owe a debt but you DO NOT owe it to these scumbags. Never ever pay them a dime. If they say they will sue then let them and don't fail to show up in court demanding verification. If they say they will take you to court then they HAVE to. If they don't that is fraud. Chances of them taking you to court are slim to none. The idiot you talk to on the phone is NOT an attorney. Doubtful if they even have a high school education. Think about it, no attorney worth anything is going to be on the phone asking you to pay a debt today or else.

Frank Falzone himself has many judgments against him for violations of credit laws. He is a DEADBEAT DEBTOR! Do NOT fall for the BS coming from this office. It is all BS. Any posts that like the one above are written by employees there. They look for sites like this. Falzone law doesnt sue anyone- ever. They buy debt in bulk for a qurter of a cent on the dollar up to 5 cents on the dollar and they violate FDCPA laws every time they make a threat against a consumer. Record every conversation and turn it in to your state's Attorney General. If what I'm saying was wrong, then there's no harm in checking it out. BUT- per FDCPA law, consumers are entitled to $1000 per violation- thats per threat, that they make- ie- wage garnishment, lein, freezing accounts, etc. The owner is a contributor as he collects with everyone else- calls himself "MIKE RICHARDS", his real name is Mike Shaw, and that in itself is a violation. Again, record, record , record.

hi!!! my hr department recieved a fax from this company regarding my employment. is this legal? everytime i call this company they leave me a nasty message & when i call back to get a validation of the debt no one will help me. what can i do? i'm affraid to answer the phone!

How many times does it have to be said, these people are JUNK DEBT BUYERS. YOU DO NOT HAVE TO PAY THEM A DIME!!!! Don't do it. They have zero interest in the debt legally. If you pay them you may as well have sent the money to me, or flushed it. Same difference. Let them sue you for it. They can not prove the debt, no way, no how. They will not sue you. Tell them to kiss off and hang up. Better yet ask if Todd Gullo is still there and if his gay lover ever got over the clap. It will send him into a screaming fit, well worth the time.
