FIA Card services told my father to tell me to prepare to go to jail!

FIA Card Services has stooped to the level of outright extortion! Yesterday, one of their in house collection reps called my father and told him to tell me that I was going to jail over a debt. Now, I owe them. No denying that. I got got behind on paying them. No denying that either. But, what they did was extortion. It began at about 8:00 am yesterday morning. FIA called my father and demanded to know where I was. He in turn demanded to know who was calling. She shouted "tell me where he is NOW!!". My father hung up. By 8:15 am, she had called back 7 more times. On the 7th phone call, my father picked up and told her that if she called back, then she would be reported to the authorities for harrassment. So, she identified that she was with FIA Card Services and that they were attempting to collect a debt on me.

He asked had they tried calling me, and she replied "yes, but he is avoiding us". That is true. I have been avoiding them. I should not have done that. But, that doesn't justify them harrassing my father. She then went on to give my father FULL disclosure. I mean everything you can think of. My full balance. How much I owed to get the account current. How long I had been a customer. How fast I ran up the card. Where I used the card. More violations of the FDCPA. The following are exact quotes of the rest of the phone call. "Your son does not know who he is screwing around with. We have power to do things to him that he can not begin to imagine. We will make his world come down around his ears. We will gun for him for the rest of his life. Your son is a criminal. Unpaid debt is a serious offense. Make him aware that we will be getting a judge to issue a bench warrant for his immediate arrest. Once he is apprehended, he will be held without bond. In fact, at this point, he may want to just go turn himself in. Plead guilty. Serve 3-5 years. Get off a little lighter. But, when he gets out, he'll still owe us. We win. Not him. He belongs behind bars. We're putting him there. Of that he can be sure. He barked up the wrong tree. Tell your criminal son that. Tell him it's over. Be sure and tell him. Stop acting like you don't know where he is. The cops will find him. You can count on that. And when they do, it won't be pretty. You get that message to your outlaw son. Tell him to grow eyes in the back of his head."

I am speechless. Where do they get off thinking they can say those things? Again, I am responsible. I owe them. I will catch back up. It just takes time. But, my gosh, these people are scum. I admit, I am terrified right now. I jump at every little sound. I will flench every time I see a police car. Do I have ANY recourse here? It seems like I should be able to file some sort of complaint. That at the very least. Thanks.


i would report them to your state AG.i don't care who they are.they can't have you arrested.again,don't care that this might be the original creditor.what they did was wrong,and you should report them to your AG.first you should call a customer service rep and let them know you will get caught up.

IF FIA Card Service did what you say they did, you should report them to your Attorney General for sure. But you should also file a Complaint against them with the Office of The Comptroller of the Currency. This is a little known but very powerful agency that Regulates National Banks. However, you should NOT File the Complaint directly with them. I recommend that you file the Complaint with either one of your Federal Senators Offices. Using your Federal Senators Office tells FIA you mean business. It also protects you. Furthermore, you will get results and respect a lot quicker. Your Senators office may ask you to sign a privacy release form. DO IT. The Form is only so the Senator can help you. Within days you will get some action. Guaranteed! Be sure to write down exactly what happened and include the information you put in your posting. Let us know what happens!
