I have never heard of this collection agency, but I've got a letter via some legal service that they filed the case against me.
Can they do file the case against me without any communication with me previously at all? Can they go straight to the court hearing? Is it just threatening me?

I really do not know what it refers to...maybe the old debt as someone mention? But I have never seem anything in my credit report that I do have something to deal with them before, although I just found that Resurgence Financial, llc checked my report a year ago.

If there is an old debt which was never appeared on the credit report and which I was not aware of, what's my responsibilities?

If you do not owe this debt then do not pay it. I would send them a debt validation letter, many drafts here just ask, but do not call them or email them. Send this letter to them certified with return reciept and make copies for yourself. Also, you may want to click on the "free consultation" icon just right of this post; they have an oasis of infomation for you. Welcome to the site.

thanks

You said they filed a legal case against you? Have you check with your court clerk and found out if there is one filed? I would check and make sure, you have to file a response with the court if they have filed on you, and be sure that you show up in court.

I have heard of some companies filing and the person not knowing until it was too late, or knowing, and not showing up for the court date, which results in a default judgement.

Get you debt validation sent ASAP, and find out if this is a "real" case or not!..Karen

I have accidentally received a letter or memo to verify my current address by a leagl service given to postmaster. Fortunately or unfortunately, postmaster mistakenlly mailed to me without post marked...that's how I know they are pursuing a legal action against me.

Does the Statute of Limitations apply to the home state of the issuer or the home state of the debtor?
